Abstract

This paper examines the ownership of maternity leaves in Chile from the perspective of the principle of equality between women and men at work. In particular, it aims to evaluate whether the regulation on maternity leave ownership in the Labor Code is consistent with the promotion of equal opportunities and treatment between women and men at work after procreation. To do this, the impact of motherhood on the work history of working women in the country is identified, the legal configuration of maternity leaves is systematized, and the relationship between the characteristics of the ownership of maternity leaves and the promotion of equal treatment and opportunities between women and men at work.
